The Council of the Parish of St. Landry, State of Louisiana, convened in a regular session on this 18th day of November, 2020 at 6:00 p.m.

  1. Chairman Coby Clavier called the meeting of the St. Landry Parish Council to order.
  1. Chairman Coby Clavier led the Pledge of Allegiance and Invocation.

Vivian Olivier, Wayne Ardoin, Dexter Brown, Timmy Lejeune and Jimmie Edwards. Ex Officio Coby Clavier. ABSENT: Nancy Carriere, Easton Shelvin and Harold Taylor. Councilwoman Nancy Carriere was late for roll call but later joined the meeting.

Chairman Coby Clavier called for a moment of silence for the families that lost their loved ones.

  • Mr. Tony Guillory thanked the council for their assistance to the constituents of Lake Charles due to Hurricane Laura. He expressed his thanks to the City of Opelousas, the Mayor- Julius Alsandor, Med-Express, Councilman Jerry Red Jr., Ms. Joel LeBlanc, Ms. Delita Rubin, Councilwoman Nancy Carriere and everyone that came out and cooked, served and handed out surprises to the people of Lake Charles.
    • Mr. Matthew Rabalais of Fire District 3 addressed the council regarding the approval of Resolution 039-2020. A Resolution approving the holding of an election in Fire Protection District No. 3 of the Parish of St. Landry, State of Louisiana on Saturday, March 20, 2021 to authorize the renewal of a special tax therein.

V.  PERSONS TO ADDRESS THE COUNCIL: #

Councilwoman Mildred Thierry suggested to Mr. Rabalais that he should explain to the constituents of District 3 that this is not a new tax. He should advise the constituents that this is a continuation tax for Fire District 3.

VI.  APPROVAL OF MINUTES: #

A motion was made by Councilman Wayne Ardoin, seconded by Councilman Jimmie Edwards to approve the Regular Meeting Minutes of October 21st, 2020 as transcribed.

VII. PARISH PRESIDENT’S REPORT: #

Parish President Jessie Bellard stated, “On adjudicated property in the parish we will start the demolition process after Thanksgiving to remove the house on Melancon Street in

Opelousas. We will clean up the property to place it on the market for sale. We are looking at doing business with another agency to handle the adjudicated property in the parish.

Once I receive the proper paper work I will present it to the council for your review.   We are starting to clean up the adjudicated properties to get them on the market for sale.” Parish President stated, “On the Public Works Report, we bought two new tractors and one of them came in yesterday. The other one will be available in three weeks.  They will begin shredding next week.” Councilwoman Mildred Thierry thanked Parish President Jessie Bellard for all the work that he has done for the parish.” Councilman Jerry Red Jr., questioned if spraying is still going on in the parish. Parish President Jessie Bellard stated,

“No, there is no spraying going on now. The weather is to cold now and it would not do any good. The way the temperature is going up and down it would only waste the chemicals.

We are trying to cut the grass down now and hopefully by the spring we can begin spraying again.” Councilman Jimmie Edwards asked for an update on Moosa Memorial Hospital in Eunice. Parish President Jessie Bellard stated, “I spoke to the Mayor of Eunice last week. He is trying to get a meeting together with that board. The hospital supposed to have

$286,000.00 in their account and with our $10,000.00 it would be enough to do the Asbestos removal inside that hospital.” Councilman Timmy Lejeune questioned the Medicaid Bill at Opelousas General Hospital. Parish President Jessie Bellard stated he did not get a chance to talk to Opelousas General regarding the Medicaid Bill. He is waiting on Mr. Ken Cochran to call us back to set up a meeting. The attorneys, Mr. Gary Frost and Mr. Ken Cochran’s attorney are discussing that issue. Hopefully we can get that set up pretty soon.

On the agenda we have an Ordinance to introduce. A special meeting will be held on November 24th, 2020. Once Garret reviews the ordinance for that Hospital in Eunice and LHC and Oceans, I will bring it to be introduced to get that part started. Opelousas General will be a separate Ordinance.” Councilwoman Nancy Carriere questioned the worn out camper trailers on HWY 190 next Kings Truck Stop. Parish President Jessie Bellard stated, I will start that process with them to see what they want to do with them. I don’t think they can sell them. They will be responsible for the cleaning up of that property. If they don’t adhere to our orders, then I guess we will be stuck with it cleaning it and we will have to charge them. I will get with Richard at the Solid Waste and see what kind of deal I can make with them to make that go better.”

Councilman Wayne Ardoin stated Mr. John C. Johnson would like to withdraw his name as a candidate for a member to the Ward Two Gravity Drainage District No. 1 Board.

A motion was made by Councilman Jerry Red Jr., seconded by Councilwoman Mildred Thierry to appoint Joseph Darrel Burleigh to the Ward Two Gravity Drainage District No. 1 Board for the remainder of a four year term ending 04-19-2021.

  1. Discuss the vision of the St. Landry Parish Ahart Airport.

Chairman Coby Clavier questioned Parish President Jessie Bellard about missing out on Economic Opportunities at the airport since there is no Airport Manager. Parish President Jessie Bellard stated, “Right now we do not have an Airport Manager. I am taking that roll until we can find someone. The difference is that the fuel sales have increased, the profits have increased because we are taking care of day to day operations and making sure that everything is done above board and top of the table. We are not missing anything. We are moving forward. We have our Architects looking at expanding one of our bigger hangers to another ten planes, and we have a waiting list. We are doing what is right for the airport. We will have a person there to take care of the day to day operations, not a manager but an Office Coordinator. We are moving in the right direction and I don’t want to jump to fast and hire an Airport Manager until we will know what direction we want to go. One of the first things we are looking at is enlarging our Hangers and we are waiting on that call to come in before I come to the council for approval.” Councilman Wayne Ardoin question if the Upholster Company Relocate? Parish President Jessie Bellard stated, “They did, and I think we will have a little issue with the location. The lots that they took or that was awarded to them are not in the best spot for that business. I will talk to Ms. Richard to see if we can take that building an move it to another location on the Airport where her front doors can meet a taxi way and make it easier for the planes to get to her and let the other tenants have use of that area a little bit better. We are in the talking stages. We are not sure how or what we are going to do. The Architect have already submitted the plains for the remodeling as it stands. That won’t change, maybe the location.” Councilman Wayne Ardoin questioned if we are buying fuel locally.  Parish President Jessie Bellard stated, “Reed Gas.”

  1.    A motion was made by Councilman Alvin Stelly, seconded by Councilwoman Mildred Thierry to authorize the Parish President to sign the amended CEA between the Parish Government and DOTD to add District 5 and District 6 to the CEA to receive Asphalt.

  1. Authorize DOTD to deliver 1000 yards of Asphalt to Ward 1 District 10.

A motion was made by Councilman Dexter Brown. Councilman Jerry Red Jr., stated, “We can’t do it. We are considered as one. We can’t deliver to a certain district. It would have to be collectively as one. Those two districts are special taxing districts. That is why we asked to do the CEA.” Parish President Jessie Bellard stated, “I will get more material.” Councilman Dexter Brown stated, “The way I have it, you are saying it is illegal. I don’t want to do anything illegal. I will withdraw my motion.

  1. Authorize the Parish President to sign the contract with Landmark Consulting L.L.C.

Parish President Jessie Bellard stated, “Landmark Consulting L.L.C. is a Consulting Firm that deals strictly with FEMA and reimbursements. There fees are part of the reimbursement process thru FEMA and they come in an capture every dollar that we can get from FEMA due to disaster that we have had with Hurricane Laura and

Delta. We would like to go with them so we won’t lose anything. It won’t cost us anything. It is all reimbursed thru FEMA.”

A motion was made by Councilman Wayne Ardoin, seconded by Councilman Jimmie Edwards to authorize the Parish President to sign the Contract with Landmark Consulting L.L.C.

Resolution 039-2020

A resolution approving the holding of an election in Fire Protection District No. 3 of the Parish of St. Landry, State of Louisiana, on Saturday, March 20, 2021, to authorize the renewal of a special tax therein.

WHEREAS, the Board of Commissioners of Fire Protection District No. 3 of the Parish of St. Landry, State of Louisiana (the “Governing Authority”), acting as the governing authority of Fire Protection District No. 3 of the Parish of St. Landry, State of Louisiana (the “District”), adopted a resolution on November 17, 2020, calling a special election in the District on Saturday, March 20, 2021, to authorize the renewal of a special tax therein; and

WHEREAS, the governing authority of the District has requested that this Parish Council, acting as the governing authority of the Parish of St. Landry, State of Louisiana, give its consent and authority for the District to hold the aforesaid election, and in the event that the election carries to continue to levy and collect the special tax provided for therein; and

WHEREAS, as required by Article VI, Section 15 of the Constitution of the State of Louisiana of 1974, it is now the desire of this Parish Council to approve the holding of said election and in the event that the election carries, to continue to levy and collect the special tax provided for therein;

NOW, THEREFORE, BE IT RESOLVED by the Parish Council of the Parish of St. Landry, State of Louisiana, acting as the governing authority of said Parish, that: SECTION 1. In compliance with the provisions of Article VI, Section 15 of the Constitution of the State of Louisiana of 1974, and in accordance with the request of the Board of Commissioners of Fire Protection District No. 3 of the Parish of St. Landry, State of Louisiana, this Parish Council hereby approves the holding of an election in the District, on Saturday, March 20, 2021, at which election there will be submitted the following proposition, to-wit:

PROPOSITION (TAX RENEWAL)

Shall Fire Protection District No. 3 of the Parish of St. Landry, State of Louisiana (the “District”), continue to levy a special tax of six and forty-three hundredths (6.43) mills on all property subject to taxation within the District (an estimated $1,217,300 reasonably expected at this time to be collected from the levy of the tax for an entire year), for a period of ten (10) years, beginning with the year 2022 and ending with the year 2031, for the purpose of acquiring, constructing, maintaining and/or operating fire protection facilities and equipment in and for the District, including the costs of obtaining water for fire protection purposes, and charges for fire hydrant rentals and service?

SECTION 2. In the event the election carries, this Parish Council does hereby further consent to and authorize the District to continue to levy and collect the special tax provided for therein.

RESOLUTION NO. 040-2020

A resolution approving the holding of an election in Consolidated Gravity Drainage District No.1 of the Third Ward of the Parish of St. Landry, State of Louisiana, on Saturday, March 20, 2021, to authorize the renewal of a special tax therein.

WHEREAS, the Board of Commissioners of Consolidated Gravity Drainage District No.1 of the Third Ward of the Parish of St. Landry, State of Louisiana (the “Governing Authority”), acting as the governing authority of Consolidated Gravity Drainage District No.1 of the Third Ward of the Parish of St. Landry, State of Louisiana (the “District”), adopted a resolution on November 10, 2020, calling a special election in the District on Saturday, March 20, 2021, to authorize the renewal of a special tax therein; and WHEREAS, the governing authority of the District has requested that this Parish Council, acting as the governing authority of the Parish of St. Landry, State of Louisiana, give its consent and authority for the District to hold the aforesaid election, and in the event that the election carries to continue to levy and collect the special tax provided for therein; and

WHEREAS, as required by Article VI, Section 15 of the Constitution of the State of Louisiana of 1974, it is now the desire of this Parish Council to approve the holding of said election and in the event that the election carries, to continue to levy and collect the special tax provided for therein;

NOW, THEREFORE, BE IT RESOLVED by the Parish Council of the Parish of St. Landry, State of Louisiana, acting as the governing authority of said Parish, that: SECTION 1. In compliance with the provisions of Article VI, Section 15 of the Constitution of the State of Louisiana of 1974, and in accordance with the request of the Board of Commissioners of Consolidated Gravity Drainage District No.1 of the Third Ward of the Parish of St. Landry, State of Louisiana, this Parish Council hereby approves the holding of an election in the District, on Saturday, March 20, 2021, at which election there will be submitted the following proposition, to-wit:

PROPOSITION (MILLAGE RENEWAL)

Shall Consolidated Gravity Drainage District No. 1 of the Third Ward of the Parish of St. Landry, State of Louisiana (the “District”), continue to levy a special tax of nine and thirty-four hundredths (9.34) mills on all property subject to taxation within the District (an estimated $780,300 reasonably expected at this time to be collected from the levy of the tax for an entire year), for a period of ten (10) years, beginning with the year 2022 and ending with the year 2031, for the purpose of acquiring, constructing, improving, maintaining and/or operating gravity drainage works and facilities within and for the District?

SECTION 2. In the event the election carries, this Parish Council does hereby further consent to and authorize the District to continue to levy and collect the special tax provided for therein.

X. ORDINANCES TO BE INTRODUCED: #

Ordinance No. 2020-022
(Sponsored by Councilwoman Mildred Thierry) AN ORDINANCE TO PROHIBIT MOBILE HOMES, HOUSE TRAILERS, MANUFACTURED HOMES, FROM BEING LOCATED IN EVANGELINE SUBDIVISION IN ST. LANDRY PARISH

WHEREAS, all tracts of land developed into official subdivisions, including the dimensions of the streets and lots, the structure and building of the houses, townhouses, and apartments, and their water and sewerage access, are approved by the St. Landry Parish Council before completion, and now, to further manage the growth and development of St. Landry Parish, it is necessary for the St. Landry Parish Council to regulate mobile homes in the parish.

WHEREAS, the population in Evangeline subdivision is increasing and it is necessary to regulate new residences in that subdivision.

BE IT ORDAINED BY THE COUNCIL FOR ST. LANDRY PARISH GOVERNMENT

THAT there shall be no mobile homes, house trailers, or any other type of manufactured homes moved into and located in Evangeline subdivision in St. Landry Parish, and the homes or residences located in Evangeline subdivision must be built or constructed on the lot that it will located on;

BE IT FURTHER ORDAINED BY THE COUNCIL FOR ST. LANDRY PARISH

GOVERNMENT THAT this ordinance shall not apply to mobile homes, house trailers, or manufactured homes that are located in Evangeline subdivision on the date that this ordinance becomes effective;

In order for this ordinance to be enforced the following requirements have to be met.

  1. A petition to enforce the Ordinance will be recorded with the council clerk prior to public hearing with more than 50% of the home owners located in the Evangeline Subdivision.
  2. Once Ordinance is passed a certified copy will be given to St. Landry Parish Permit Officer.

Parish President Jessie Bellard stated, “I would like to remove this Ordinance for introduction at this time. On next Tuesday, November 24th, 2020 we will have a Special Budget Meeting and I will have this Ordinance ready to be introduced at that time. We want to make sure that everything is right before we bring it to the council.
